Man Wasn’t Driving – Could Go to Prison for Policeman DUI Death

This is a very strange and unique case where an alleged drunk driver is being charged with vehicular manslaughter for the death of a policeman who was killed while on the scene investigating two accidents allegedly previously caused by the negligent actions of the intoxicated driver.  The appeals court ruled that the Defendant should have known that it was foreseeable that if he drove drunk and caused an accident, that injury or death could result to those individuals drawn to the scene to aid or investigate.

The Court’s theory is really stretching the bounds of “foreseeability”. I do not believe it will be upheld.
